Terms And Conditions
1. Introductory Provisions
1.1.
These Terms and Conditions ("Terms" hereinafter) set the rights and obligations for the Operator and the Users of the portal located at www.zonerama.com and for related services (the "Portal" hereinafter).
1.2.
The Operator of the Portal and related services is the company ZONER software, a.s. with the Czech national organization ID (IČ) 494 37 381, the tax ID (DIČ) CZ49437381, and headquarters at Nové sady 583/18 in Brno, Czech Republic, postal code 602 00. It is registered in the commercial register at the Brno Regional Court (Krajském soudu v Brně), section B, insert no. 5824, and was founded under the laws of the Czech Republic. Questions and suggestions can be sent to the Operator using a form located on the Portal.
1.3.
A User is any physical person with an interest in using the Portal's services who is sufficiently mentally mature to use them and who has registered as a User in the stipulated manner. A person other than a User can use only those Portal services that do not demand User registration.
2. Registration and Entry into Contract
2.1.
Registration consists of completely and truthfully filling in the information requested in the appropriate registration form and confirming acceptance of these Terms. At the moment of performing registration, a person becomes a User and a user account is prepared for them, available only after entering a password of their choice. In the case of changes to information entered for an account, the User is obligated to immediately change the data in their user account in the stipulated manner. The Operator is entitled to request the User to provide further data after registration and the cancel the User's registration if it is not provided within an acceptable deadline. The Operator is not responsible for any abuse of a user account by a third party.
2.2.
The act of registration causes the closure of a contract on use of Portal services between the Operator and the User ("Contract" hereinafter). The Contract contains the rights and obligation listed in these Terms. The closing of this Contract under these Terms does not affect the right of the Operator to offer the User paid Portal services under special conditions.
2.3.
On the basis of the Contract, the User is entitled to use all current Portal services that the Operator has provided for non-paid use, and the Operator takes on the obligation to enable the use of these services for the duration of the Contract.
2.4.
The services of the Portal include the option for the User to save and, per their judgment, make public ("publish" hereinafter) photographs or other graphical data on the Portal ("photographs" hereinafter), edit and delete the stored or published photographs, and use other current services mentioned on the Portal.
3. Rights and Obligations
3.1.
The User will take into account the following:
a)
In accord with the provisions of § 5 of Czech Act no. 480/2004 Sb., the act on certain information society services and on amendments to certain other acts (the act on certain information society services), as later amended, the Operator is responsible for the contents of photographs stored by the User on the Portal only when:
i)
due to the nature of the Operator's line of business and of the circumstances, and to the nature of the case, the Operator could know that the contents of the photographs or the actions of the User are unlawful, or
ii)
the Operator has provably been informed on the unlawful nature of the stored photographs or the unlawful actions of the User and has not taken without delay all steps that can be demanded of the Operator to remove or make inaccessible those photographs that violate the law.
b)
The Operator is not obligated to monitor stored photographs and is not obligated to actively seek out facts and circumstances pointing to unlawful activity by the User.
c)
The Operator is not responsible for deletion of photographs from the Portal.
d)
The Operator is entitled to restrict the number of photographs stored.
e)
The User is not entitled to store on the Portal photographs whose production, possession, distribution, publishing, or other manipulation violates generally binding legal regulations or that are morally questionable or in conflict with the principles of civic harmony.
f)
Under generally binding legal provisions, the User holds sole responsibility for the contents of stored and published photographs, and this responsibility is not affected by any eventual responsibility of the Operator.
g)
The Operator enables the general public to call attention to the illegality of stored or published photographs.
3.2.
The User agrees that the Operator is entitled, without prior notice, to make inaccessible or delete from the Portal any photograph if:
a)
the storage or publishing of the photograph could lead to a legal violation.
b)
the Operator has cause to believe that storing or publishing the photograph could impact the rights of third parties.
c)
the law restricts publishing the photograph on the grounds of its contents, due to the age of possible visitors to the Portal.
d)
the Operator has cause to believe that photographs were stored or published for the purpose of fraudulent business practices.
e)
the User that stored the photograph on the Portal has cancelled their registration, or the User's registration has been cancelled by the Operator for a reason listed in these Terms.
3.3.
The Operator is entitled, without prior notice, to simultaneously cancel the User's registration while deleting or making inaccessible photographs. Likewise, the Operator is entitled to cancel registration if the User has provided untruthful or incomplete information during the registration process.
3.4.
The Operator is entitled to enact changes to the Portal services at will.
4. Termination of Contract
4.1.
The User is entitled to terminate the Contract on use of Portal services. The User announces their intention to terminate the contract to the Operator using functions of the Portal (contact form, etc.).
4.2.
Upon violation of the conditions of this contract, the Operator is entitled to terminate the Contract and cancel the User's registration, effective immediately.
5. Concluding Provisions
5.1.
The User takes into account that by performing registration they are voluntarily providing the Operator with their personal data, protected under the corresponding laws. By performing registration, the User provides to the Operator their assent to the processing of the personal data provided during registration. The User can retract this assent in writing at any time.
5.2.
The User agrees that the Operator is entitled to use stored photographs as per their best judgment for the purposes of promoting the Portal and related services.
5.3.
The Operator and the User agree that without regard to the User's place of residence or other place of accommodation, or to any eventual place of registration or place where the Portal service is used, the Contract and their relationship regarding the use of Portal services abide by the legal code of the Czech Republic.
5.4.
The Operator is entitled to alter these Terms. A change to the Terms becomes valid and effective as regards the User at the moment when it is placed on the Portal.
5.5.
These Terms are valid as of October 4th, 2011.
